The U.S. Supreme Court is set on Tuesday to consider the legality of a regulation issued by President Joe Biden's administration cracking down on "ghost guns," largely untraceable firearms whose use has proliferated in crimes nationwide.

The ATF defends the rule as necessary to combat the threat of ghost guns, which are being used in a growing number of crimes across the nation.

The Supreme Court takes on another battle over restrictions on firearms as the justices consider the Biden administration's move to ban "ghost gun" kits that allow people to assemble deadly weapons at home while skirting existing regulations.

The rule from the Bureau of Alcohol, Tobacco, Firearms and Explosives seeks to ensure ghost guns are subject to the same requirements as commercial firearms sales.

The government contends that ghost guns kits count as a firearm under a 1968 law. But those challenging the rule contend “a kit of parts is not a weapon.”
